The Ministry of Trade, Industry and Energy (hereinafter referred to as the “Ministry”) processes and safely manages personal information in compliance with the Personal Information Protection Act and the applicable laws and regulations to protect the freedom and rights of information subjects. Accordingly, in accordance with Article 30 of the Personal Information Protection Act, the Ministry has established and published its privacy policy for personal information processing as outlined below, to inform subjects of the procedures and standards for processing personal information and to ensure prompt and smooth processing of grievances related thereto.

  • 1 The Ministry will not use personal information processed by the Ministry for any purpose other than the prescribed purposes. If the purposes change, the Ministry will take necessary measures, including obtaining separate consent, in accordance with Article 18 of the Personal Information Protection Act

Provision of personal information to third parties

The Ministry provides personal information to third parties only in cases specified under Article 17 or 18 of the Personal Information Protection Act, which include the consent of the information subject and special provisions in a statute.

Entrustment of personal information processing

  • 1When entrusting the processing of personal information, the Ministry specifies in relevant documents, such as contracts, the prohibition of processing personal information for purposes of other than performing the entrusted work, measures to ensure safety, restrictions on sub-entrustment, management and supervision of contractors, and liability for damages, in accordance with Article 26 of the Personal Information Protection Act. The Ministry also supervises whether the contractors handle personal information safely.

Destruction of personal information

  • 1The Ministry will destroy personal information promptly when it becomes unnecessary due to factors such as the expiration of the personal information retention period or the fulfillment of the purpose for which it is processed.
  • 2However, even after the retention period agreed upon with the information subject ends or the purpose of processing is achieved, personal information will not be destroyed if it needs to be retained under other statutes.
  • 3Personal information is destroyed in accordance with the following procedures and methods.

      The Ministry selects the personal information (or personal information files) that needs to be destroyed, and destroys the personal information (or personal information files) upon approval from the privacy officer.

      The Ministry destroys personal information recorded and stored in electronic files by taking measures to prevent its restoration, and destroys personal information recorded and stored in paper documents by shredding or incineration.

Rights and obligations of information subjects and legal representatives, and how to exercise them

  • 1An information subject may exercise the right to demand that the Ministry grant access to or correct, erase, or suspend processing of personal information.

    ※ Requests regarding personal information of children under the age of 14 must be made personally by their legal representative, and information subjects who are minors aged 14 or older may exercise their rights regarding personal information by themselves or through their legal representative.

  • 2An information subject can exercise the rights in writing, via e-mail, facsimile (FAX), or other means to the Ministry of Industry in accordance with Article 41 (1) of the Enforcement Decree of the Personal Information Protection Act, and the Ministry will take the requested actions without delay.
  • 3An information subject can also exercise their rights through their legal representatives or other authorized persons. In such cases, a letter of attorney should be submitted using Attached Form No. 11 of the Public Notice on the Processing Methods of Personal Information (No. 2023-12).
  • 4An information subject’s right to access personal information and demand the suspension of processing may be restricted under Article 35 (4) or 37 (2) of the Personal Information Protection Act.
  • 5An information subject may not demand the correction or erasure of personal information if its collection is stipulated by another statute.
  • 6Upon receiving a demand to grant access to, correct or erase, or suspend the processing of personal information, the Ministry will verify whether the demand was filed by the information subject or a duly authorized representative.

Matters regarding the processing of personal information for children under 14

  • 1 ① In case of collecting personal information from children under 14, the Ministry may request only the minimum required information, such as the name and contact information of the child’s legal representative. The Ministry will verify whether a lawful legal representative has provided consent by instructing the legal representative to do so on the internet website where the terms of consent are displayed and by sending a text message to the legal representative's mobile phone to confirm that the consent has been provided.
